Litigation Lawyer Responsibilities
- Act as the legal representative of AirAdvisor in Spain, handling all legal matters and claims filed within the jurisdiction.
- Prepare and file batches of approximately 200+ legal new claims monthly in Spanish courts against various airlines to recover compensation under EU Regulation 261/2004, Turkish SHY Regulation, reimbursement of out‑of‑pocket expenses, and ticket refunds.
- Handle baggage‑related claims, including cases of delayed, damaged, or lost luggage, in accordance with the Montreal Convention and/or Warsaw Convention.
- Respond comprehensively and assertively to airline legal defenses, including substantive arguments and procedural and jurisdictional challenges.
- Lead enforcement of court judgments, initiating enforcement proceedings and coordinating with bailiffs or enforcement authorities.
- Engage in court‑led settlement negotiations and represent AirAdvisor’s interests in securing favorable in‑court settlements.
- Maintain complete and accurate legal case files, ensuring compliance with Spanish legal ethics, data protection regulations, and professional standards.
- Conduct legal research and comparative analysis to compile best practices for managing recurring legal issues in airline and consumer rights litigation.
- Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and judicial precedents, providing updated legal advice and representation.
- Support the optimization and automation of claims management workflows, leveraging legal technology solutions, including AI‑based tools.
- Identify and propose new civil claims business opportunities viable under Spanish law, targeting low‑value, high‑volume litigation potential.
- Conduct cross‑jurisdictional legal research across EU and UK markets to identify relevant precedents and advanced practices for adaptation in Spain.
- Represent AirAdvisor in local media, coordinating with AirAdvisor’s PR Manager to maximize public relations opportunities surrounding landmark court rulings or critical legal developments.
- Advocate for passenger and consumer rights within the airline and travel industry, promoting fair treatment and legal protection for air travelers.
Qualifications
- A valid Attorney at Law license in Spain and professional liability insurance.
- A law degree from an accredited institution.
- Experience with small claims, consumer rights, or aviation law is a plus.
- Knowledge of relevant consumer protection laws and aviation regulations is a plus.
- Proven track record of success in in‑court collection.
- Strong analytical and problem‑solving skills, effective legal research, and strategic legal strategy development.
- Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
- Experience in automating and standardizing claims management processes to scale up quickly.
- Free from conflicts of interest, able to litigate claims against different airlines.
