Our client is a large multinational healthcare company. The Group is a relevant worldwide supplier of essential drugs, clinical nutrition products and medical devices.
POSITION
Spanish senior lawyer to lead all Legal matters of the Group Spanish branch. Candidates will have over 8-10 years of PQE advising pharmaceutical, biotechnology or medical devices’ companies on Legal matters. 3+ years of experience managing teams is required.
Candidate will be the Head of Legal Spain of the company and lead a small team. He/she will be based in Barcelona.
Full competency in Spanish and English is required. German is a plus.
REPORT LINE
Direct report to the Supervisory Board and CEO of the Spanish Branch, and to the Regional/Global General Counsel of the Group.
JOB PURPOSE
- The Head of Legal Spain will act as primary legal advisor to the Group’s Spanish Legal entity, including the Data Protection matters.
- He/she will provide legal support and advice on a wide range of commercial, operational, and governance issues, with emphasis in supporting the local Business Units and the Production Plant.
- The Head of Legal Spain will be performing legal services for the Spanish branch involving consultation, advisory, document, review and drafting contracts, analysing activities, and managing public tenders.
- The role includes providing legal counsel to the management board and other senior management.
- Partner with local and regional management and Headquarters’ teams to implement legal strategy and projects.
- Representing the company in industry associations meetings.
TASKS AND RESPONSIBILITIES
- Give accurate legal direction to the leadership team on all matters that influence the organization.
- Lead and organize work of external lawyers
- Ensure the company’s compliance with all applicable laws, regulations, and industry standards.
- Oversee the development and implementation of compliance programs and policies.
- Identify and mitigate legal risks, providing proactive solutions to minimize exposure.
- Review, draft, and negotiate a wide range of commercial contracts and agreements.
- Establish and maintain efficient contract management processes and systems.
- Manage and oversee all litigation, arbitration, and dispute resolution matters.
- Work with external legal counsels, ensuring cost-effective and high-quality legal representation.
- Advise on corporate governance matters and ensure adherence to best practices.
- Ensure proper legal documentation and policies are in place.
- Stay current with changes in laws and regulations that may affect the company’s operations.
- Advocate for the company’s interests in legislative and regulatory matters.
- Ensure proper procedures for the identification, protection, and commercialization of intellectual property.
- Support company expansion in new markets.
- Advise on key legal areas, including Distributor Markets, Global Key Accounts, Competition (Antitrust), and Human Resources.
- Provide regulatory and strategic guidance on Clinical Research, Marketing, and Quality matters.
- Support mergers, acquisitions, and business development projects with a hands‑on approach.
- Establish and refine contract templates, related processes, and conduct legal training.
- Oversee legal operations and corporate governance for assigned EMEA South and/or UK/IRL regions.
- Work closely with business partners to mitigate risks and align legal strategies with business goals.
- Conduct legal research and manage external counsel relationships effectively.
SKILLS & QUALIFICATIONS
- Bachelor’s Degree required: lawyer qualification preferred, under Spanish legal system.
- 8-10 years of experience advising a pharmaceutical, biotechnology or medical device company on compliance matters is required. In‑house experience is a plus. 3+ years of experience managing teams.
- Strong experience in commercial law, competition, regulatory, contract negotiation, manufacturing and public law (contracts and proceeding).
- In‑depth knowledge of Digital Law including GDPR and cybersecurity.
- Demonstrate good judgment and decision‑making ability, flexibility and commitment.
- Work independently and multitask in a fast‑paced work environment.
- Management skills: ability to interact with local management on eye level.
- Personal skills: assertive person of trust with high level of integrity, conscientiousness and accuracy, confidentiality and discretion; strong sense of service and initiative.
- Intercultural skills: Experience in working with people of all hierarchies and different cultural backgrounds.
- Language proficiency: fluent in Spanish and English. German is a plus.
