Job summary

Position Summary

This role is responsible for providing interpretations, enforcement, and advice regarding by-law enforcement policies and procedures, as well as relevant legislation to both Division management and enforcement personnel. The incumbent will review new or amended legislation, as it relates to the County’s regulatory by-laws, Provincial Act, by-law enforcement, and individual rights. It is important to be aware of case law and how it affects interpretations and implementation of all municipal regulatory by-law as well as other issues, i.e., civil matters. The personnel will enforce a variety of municipal regulatory by-laws and legislation, including zoning by-laws, and serve as Property Standards Officers. They will also collaborate with other enforcement agencies, such as the Ontario Provincial Police (OPP), Fire Department, Ministry of Environment, and Conservation & Parks on common areas of concern. Lastly, they will implement enforcement strategies, tools, and legal proceedings to efficiently gain compliance, to ensure health safety, customer service, and consumer protection through their various legislative responsibilities.

Qualifications, Knowledge, and Skills

Education

• Community college graduate in studies relative to accountabilities (for example, Law & Security)
• Must be a certified Municipal Law Enforcement Officer
• Must be a certified Property Standards Officer

Experience

• A combination of over three and up to and including four years previous related work experience and on the job experience, or equivalent.

Knowledge/Skills

• Sound knowledge of relevant legislation and municipal by-laws, procedures, etc.

Responsibilities

The incumbent is responsible for, but not limited to:

Functional

• By-Law Compliance
  • Conduct all aspects of enforcement for a number of regulatory By-laws passed by Council including Property Standards, Zoning, Clean Yard, Public Parks, Noise, Site Alteration, Sign, Licensing (taxi, mobile food premise, salvage), Fence, Boulevard Maintenance, Parking, Winter Control, Snow Removal, Curb side Collection and Provincial Acts, such as the Weed Control Act, and Planning Act
  • Moving violations involving truck routes, trucks used in Site Alteration and unlicensed taxicabs
  • Independently manage and prioritize new and ongoing investigations
  • Respond immediately to dispatched occurrences, as may be required by Supervisor/Manager
  • Back up other Municipal Law Enforcement Officers as needed to ensure operational Officer safety
  • Keep / maintain a detailed account of investigations and ensure / accountable for evidence security
  • Provide contactor authorization to do work to bring properties into compliance with By-laws
  • Conduct searches to confirm ownership of property through the Ontario Land Property Records Portal for all cleans up over $1,000
  • Review contractor invoices to confirm invoice aligns with work completed
  • Take follow-up action in response to complaints of alleged by-law violations; investigate to determine validity of complaint; follow up through issuance of letters and / or order to comply
  • Plan / organize patrol schedules for parking enforcement program; issue tickets when a clear violation is evident
  • Undertake administrative actions required to ensure appropriate follow-up and conclusion of violations
  • Ensure that all requirements for licensing by-laws are adhered to for salvage yards, food premise and taxi cabs and motor vehicle racing.
  • Enforcement of a number of Municipal By-laws, such as but not limited to, Public Parks, Site Alteration, Zoning, Nuisance, Property Standards, Clean Yard, Noise, Fence, Boulevard Maintenance and Curb side Collection with the designation of a Provincial Offences Officer
  • Assist with drafting of municipal by-laws, by-law amendments and public notices, as required
• Legislative Laws and Requirements
  • Gather and properly process evidence pursuant to the Ontario Evidence Act, Canada Evidence Act, Canadian Charter of Rights and Freedoms
  • Lay charges pursuant to the Provincial Offences Act
  • Serve Summons compelling persons to attend court
  • Present before committee regarding Property Standards, Fence By-law appeals
  • Provide deficiency reports for Planners used in Fence By-law appeals
  • Implement enforcement remedies found in the Building Code Act, Planning Act and Municipal Act
  • Liaise, coordinate and support inspections and enforcement with OPP, Fire Department, SPCA, and Provincial agencies such as the Ministry of the Environment, Conservation and Parks and Health Unit
  • Prepare cases for Court based on investigation (for example, prepare and swear affidavits, subpoenas and various other Ontario Court documentation and service and file same, arrange initial court dates, prepare summarization of occurrence and Crown Prosecution briefs and include required certified documents, land title searches)
  • Attend at court (POA, Supreme Court of Ontario) for Examination for Discovery, Notice of Motion and trials to provide testimony
• Supervisory Responsibilities
  • Schedule and provide on-site functional guidance to contractors doing work on behalf of the County, including but not limited to: clean-up/removal of waste, cutting long grass, removal of trees, repairs to unsafe buildings and structures (including demolition of same when needed), clearing sidewalks of snow, towing vehicles and clearing mud from roads
  • Provide support, guidance and assist with priority setting of as it relates to summer enforcement students, as determined by the Manager/Supervisor
• Reports & Recordkeeping
  • Respond to and document all complaints received from the public.
  • Record all enforcement activities and inquiries into CityView
  • Research and / or coordinate information for various manuals / procedures and provide recommendation regarding action to be taken
