Job summary

Downer Energy & Utilities is seeking a Commercial Manager - Upstream to join the commercial team. The role supports the Head Contract administration and development of commercial strategies across multiple project locations in Australia.

Ideal candidates hold a law/engineering/CM/QS degree with 10+ years in commercial construction roles, especially with head contracts. This senior position offers a clear career path within a Tier 1 ASX-listed company.

Qualifications

• Degree in law, quantity surveying, construction management or engineering.
• 10+ years in a commercial role in construction projects, preferably energy/power transmission.
• Experience managing head contracts and related claims/variations.
• Excellent working knowledge of Australian construction contracts.

Responsibilities

• Develop, implement and administer upstream Commercial Management Plans, Manuals and Registers.
• Administer the Head Contract to protect Downer's rights and fulfill obligations.
• Manage contractual correspondence with the Client related to the Head Contract.
• Contribute to project management plans ensuring compliance across procurement, operations, HSE and stakeholders.
• Manage Head Contract changes, including preparation, submission and negotiation of claims/variations.
• Provide expert advice to inform decision making and commercial strategies.

The opportunity

The Commercial Manager - Upstream will be part of the commercial team within Downer's Energy & Utilities Power Projects business unit. This role can be located either Hexham, NSW, North Ryde NSW or Brisbane QLD. The successful candidate can envision themselves attending to duties such as:

What you'll do

• Develop, implement and administer the upstream Commercial Management Plans, Manuals, and Registers, required by the Head Contract and The Downer Standard and Delivery Management Methodology
• Be responsible for the timely and effective administration of the Head Contract to ensure that Downer's rights are maintained and obligations fulfilled
• Manage contractual correspondence and communications with the Client associated with the Head Contract
• Implement strategies and contribute to Project Management Plans to ensure Downer's compliance with its Head Contract obligations across the entirety of the Project, not limited to key functions including Procurement, Operations, Health, Safety and Environment, Community and Stakeholder, and Projects Controls
• Manage Head Contract Change, including the preparation, submission and negotiation of upstream Claims and Variations
• Collaborate and provide expert advice and guidance to inform decision making and the implementation of commercial strategies

What we're looking for

• Bachelor's degree in law, Quantity Surveying, Construction Management or Engineering preferred
• 10 plus years of experience in a commercial role in construction projects preferably within the power transmission / energy sector
• Experience with managing head contracts and complex head contracts claim preparation and negotiation
• Excellent working knowledge of Australian construction contracts
• You are familiar with standard and bespoke industry forms of contract and their negotiation and operative effects
• Demonstrate strong interpersonal, communication and presentation skills
• Displays a continuous improvement mindset - has a continuous improvement attitude, always looking for ways to improve on current processes and performance
